Germany upholds Motorola ban on Apple's iCloud, MobileMe

A Mannheim court on Friday reinforced an earlier decision to allow Motorola's ban on iCloud and MobileMe in Germany. The ruling on push services demands that Apple pays Motorola an unspecified amount of damages. Devices themselves are so far unaffected.The same court adjourned a decision on 3G patents that would affect iPhones and 3G-capable iPads. No timetable was given for when a more definitive answer would come in that case.

Motorola's win in the cloud-oriented case was considered a more likely win. Complaints have been massing, however, that Motorola's insistence on using standards-based patents has sparked complaints of patent abuse both from Apple and from Microsoft. The Droid RAZR designer has been asking for a 2.25 percent royalty on the total device cost, no matter how much less others companies' patents cost, and would visibly raise the price of many devices to compensate.

The European Commission just recently began investigating Motorola for possible patent abuse and could negate its main offenses against both Apple and Microsoft.
