Dude, you still here?

“”

That was the subject line of the first email in my inbox this morning.  It was one of several in there actually but was by far the best attention getter.

The short answer, by proof of this post, is yes, I’m still here.

The last update I made to AlliOSNews was way back on May 1st.  That’s right, 20 days ago.  In between that post and this one, I’ve traveled over 12,000 miles on multiple continents for what I affectionally refer to as “the day job”.  To say I’ve been busy is, well, an understatement.

Fortunately things are calming down – for the moment at least – and I should be able to post more regularly.  But I have to say a heart felt thank you to all of you who emailed to check in on me.  All is good.  All is well.  I’m advocating for a 28 hour day but that’s another discussion.

See you on the Tubes….

RIM, Motorola submit compromise nano-SIM design

0160(8)3updated 10:38 am EDT, Fri May 18, 2012 Uses Apple's design as template

RIM and Motorola have submitted a new, compromise nano-SIM design based on a concept from Apple, reports say. The new design has the same outline and contacts as Apple's proposal, but with a notch on one side making space for what RIM calls a "push-push" mechanism; pushing in the card once secures it, pushing it in again pops it out. Apple's idea may have been less practical, requiring a tray to hold a card steady.Nokia opposed Apple's original design on the principle that it violated a "no jamming" rule. The length of the card was said to be too close to the width of modern micro-SIMs, making it possible for a person to accidentally wedge Apple's nano-SIM into the wrong slot. In response, though, Apple created a slightly updated design with new dimensions.

Apple has previously expressed its own opposition to adding a notch, suggesting that it would increase time-to-market by shrinking the space for silicon. It remains to be seen, therefore, what kind of traction the RIM/Motorola design might have. The European Telecommunications Standards Institute is scheduled to have another meeting on the nano-SIM standard on May 31st, at which point a decision should be reached on submitted concepts.

New lawsuit accuses Apple of botching Mobile Me transition

2160(0)16updated 01:19 pm EDT, Fri May 18, 2012 Move to iCloud accompanied by headaches, says plaintiff

A new class action lawsuit has been filed against Apple in California, accusing the company of "unfair, unlawful, deceptive, and misleading practices" in promoting iCloud, according to AppleInsider. The case -- filed on behalf of Danyelle Comer in the US District Court for the Northern District of California -- specifically targets Apple for failing to properly transition paid Mobile Me subscribers over to iCloud. "Throughout the migration, Apple failed to adequately ensure that features Mobile Me users were paying for would be accessible, including access to their e-mail accounts for which customers pay additional fees," complaint documents read. "As a result, numerous Mobile Me users suffered damage from the inability to access their individual accounts."Apple is said to have "misrepresented" iCloud in advertising, in that the company was allegedly ill-prepared for transitioning Mobile Me customers, with "devastating" results. "Unfortunately for many users it doesn't 'just work' and has resulted in a series of headaches due to lack of syncing ability, lack of email functionality and other complications and losses and corruption of data," the complaint goes on. "In fact a number of users have been forced to hire outside technical assistance at significant cost, just to migrate to the iCloud platform or get around it to obtain minimal functionality of emails and other systems."

The filing also makes references to problems merging Mobile Me accounts with Apple IDs; when buying apps and the music at the iTunes Store, for instance, users might have used an Apple ID separate from the email address linked to Mobile Me, forcing a person to choose between their purchases or their address. Another issue is said to be downtime, since iCloud and Mobile Me email accounts have supposedly been inaccessible at times when Apple's status system said they were running properly. "Apple's most dedicated consumers, including those who paid for Mobile Me service have continually experienced problems with iCloud migration, including lack of email for extended periods," the suit says.

Apple is charged with unjust enrichment, breach of express warranty, breach of implied warranty of merchantability, and violating the California Consumer Legal Remedies Act as well as the Magnus-Moss Warranty Act. Mobile Me is currently in its last weeks of life; after June 30th the service will shut down, taking with it anything not migrated over to iCloud, though me.com and mac.com email addresses will still function.

Apple legal 'requests' demand London AppleExpo name change

0120(0)2updated 03:58 pm EDT, Fri May 18, 2012 First London expo retitled the 'Appule Expo'

In the wake of legal "requests" sent to its organizer, the London-based Apple Expo is now called the Appule Expo. Undaunted, Microsoft has recently booked space at the show. The newly named gathering will take place on October 11 and 12 of this year. Apple is not expected to attend.Microsoft will likely showcase Office for Mac, and a possible upgrade for Mountain Lion. Office tools for iOS are also expected to make an appearance in some capacity. A full list of exhibitors will be available at the expo's website at the end of May.

A Mac-titled show was last held in London in 2007, the last year Apple participated in a UK-based exhibit. The following year, Apple pulled out of the Paris Expo. In 2009, Apple stopped attending the San Francisco Macworld Conference and Expo, and seriously limited other trade show attendances.

Apple claims trade shows are unnecessary and a waste of company resources. Apple's retail stores draw in excess of seven million customers per week worldwide. A quote from Apple in 2009 at the time of the withdrawal from the trade show circuit stated "The increasing popularity of Apple

Rumor: Amazon to launch 10.1-inch Fire, delay 8.9-inch plans

0160(0)0updated 04:29 pm EDT, Fri May 18, 2012 Amazon to take aim with Kindle Fire against Apple iPad

Amazon may delay the rumored 8.9-inch Kindle Fire and launch a 10.1-inch model instead. According to DigiTimes, sources speculate that the larger screen will help compete with the iPad, whereas the 8.9-inch variant was said to be designed to go against the Samsung Galaxy Note. Other sources yesterday spoke of releasing a front-lit version of the Kindle e-reader in July, and a larger Kindle Fire, but did not mention any expected release period for the latter. The same sources downplayed the possibility of a color Kindle e-reader due to the technology needing further improvement.

The Kindle Fire, released last year, became the most popular Android-based tablet until sales dropped after the holiday season. Despite the high sales, the device lagged far behind iPad sales numbers.

More regional carriers debut iPhone 4S

2160(0)0updated 07:30 pm EDT, Fri May 18, 2012 Oklahoma, Puerto Rico latest additions

Continuing with a string of recent arrivals on US regional carriers, the iPhone has arrived to two news that cover northwest Oklahoma and Puerto Rico, respectively. Open Mobile, the Puerto Rico carrier, may be the first exclusively no-contract carrier in the US to offer iPhones. Oklahoma-based Pioneer Cellular is carrying only the iPhone 4S, while Open Mobile has both the 4 and 4S at various capacities. The Pioneer Mobile site hasn't been fully updated with pricing and relevant sales data for the iPhone 4S, instead directing customers to a generic channel partners page that lists the features and some of the selling points of the iPhone 4S. The company is expected to sell iPhone 4S models at the standard rates of $199 and up with a two-year contract. It began its rollout today and will expand to all its stores over the next month.

Open Mobile offers customers one of two options on four models of iPhone: outright sales and an "Open Plan" with a non-refundable deposit and a pre-paid $70 per month unlimited plan. Open offers the 8GB iPhone 4 for $335, or $285 if the customer is switching from another carrier. The 16GB iPhone 4S is $435 (or $335 for switchers), while the 32GB iPhone 4S costs $535 or $435 for switchers.

The 64GB model is $100 higher in both cases. The $70 per month pre-paid Open Plan includes unlimited minutes and texting, along with unlimited data (in Puerto Rico only) and up to 250MB of roaming data when in the United States. The commonwealth of Puerto Rico is an unincorporated territory of the US, and though not a state is considered a part of the country while still retaining a degree of separation.

Several regional and small carriers have recently added the iPhone over the last two months, including carriers in California, Kansas, Kentucky, Alaska, Virginia, Wisconsin and much of the US southeast

Indie Jobs movie to film at original Apple 'garage' site

2120(1)1updated 09:01 pm EDT, Fri May 18, 2012 Modifies title to 'jOBS,' now a made-for-TV feature

The independent biopic of Apple co-founder and former CEO Steve Jobs starring Ashton Kutcher that begins filming next month has modified its title to simply jOBS with the "Get Inspired" portion that was previous thought to be part of the title now identified as just a tagline. The low-budget production from Five Star Feature Films says it will commence principle photography next month, including the actual Los Altos home of Jobs' parents, including the garage that started it all.The garage at the Jobs' home was Apple's official listed headquarters during its early days before the fledgling company moved to rented office space in Cupertino to build the Apple II. The movie, said now to be planned as a made-for-TV film, will cover a period of about 30 years in Jobs' life from around 1970 to 2000, from his formative years and founding of Apple through to his return to the company and first successes under his second term as CEO.

The company says in a statement that it is committed to an accurate and authentic look at Jobs and the people in his life at various periods, and calls the film "dark, honest and uncompromising" with a narrative that "pulls no punches and does not speculate" on its subject. In addition to casting Kutcher (who bears a resemblance) as Jobs, unconfirmed reports suggest that Book of Mormon star Josh Gad could be cast as Steve Wozniak in the film. Executive producer Mark Hulme has said that he expects the film to be complete before the end of the year.

Sony Pictures is also planning a movie about Jobs, a multi-million dollar production based on Walter Isaacson's biography. The Social Network screenwriter Aaron Sorkin is to write the screenplay, but no casting or schedule announcements have been made.

Apple working on multi-point touch focus for iOS

4(1)0updated 10:04 pm EDT, Fri May 18, 2012 Patent application shows advanced technique

A recent patent award reveals plans for further improvement in iOS cameras, allowing for two or more different zones of an image to be selected for focus and other settings, with the camera selecting a compromise point automatically if there is too much difference in the selected zones. The patent application also suggests that future iPhones might incorporate a dedicated image processor for photos and video. The patent, which was first applied for in 2010, describes and ability of the user to tap an area to direct focus as is already implemented in the iPhone 4 and 4S. Where the patent goes beyond current capabilities is in its ability to create multiple zones of focus, and its mention of possible motion tracking for focus purposes (for example, selecting a particular person to focus on while shooting video where the focus stays on the person regardless where they move to).

The ability, if implemented, would put iPhones or iPads well past the abilities of most lower-end consumer cameras in terms of being able to handle challenging focus situations automatically. In addition to being able to select multiple focus zones, the user could also separately select regions to set aperture and exposure levels for both photography and video.

The iPhone 4S and iPhone 4 are already the most popular non-DSLR camera models on most popular photography websites such as Flickr and Instagram, and in fact the iPhone 4 has surpassed even DSLR models to the single most popular camera on Flickr, with the iPhone 4S already surpassing most DSLRs (save the Canon EOS 5D Mark II). The iPhone 4S brought noticeable improvements in lens technology to the iPhone's camera that only a few competitors have been able to match or surpass.

The patent, numbered 20120120277, was granted on May 17. It lists Apple engineer Richard Tsai as the sole inventor.

Facebook acquires social-gifting startup Karma

2160(1)0updated 10:48 pm EDT, Fri May 18, 2012 Terms of buyout remain unclear

Facebook's initial public offering remained the biggest story in tech throughout the day, overshadowing the social network's latest acquisition, Karma, a company that specializes in mobile social gifting. The startup has developed an e-commerce platform that enables mobile users to quickly find gifts, select a personalized card, and notify the recipient via text message, e-mail or Facebook. The company partners directly with a wide range of brands, enabling the recipient to have a certain level of control over their gift. Depending on the particular product, recipients can choose different flavors, styles or colors. The gift can also be swapped for something else, or the value can be sent to charity.

The system eliminates the need for buyers to determine a correct address or other personal details, as recipients are asked to input shipping information after they finalize the gift. Karma then wraps the product as a gift and sends it along to the recipient.

"The service that Karma provides will continue to operate in full force," Karma wrote in a statement on its website. "By combining the incredible passion of our community with Facebook

Apple Stores underway in US, Canada, France, UK

0120(1)0updated 11:24 pm EDT, Fri May 18, 2012 Company to open 40 new stores in 2012

On the heels of last week's opening of the Murcia, Spain Apple Store, various sources have reported stores underway or near opening around the world. The next most likely international store is thought to be in Paris, France in the La Defense district, which is scheduled to open on May 26. Also coming later in the year is a new story in Salt Lake City, Utah; one near Bakersfield, California; a planned expansion of the existing store in Calgary, Alberta in Canada, and Apple has allegedly taken over a lease on a store in Plymouth, England. The Apple Store Quatre Temps in Paris will be the 11th for the country and take the place of a Go Sport store in the shopping center, according to Defense92.net, which also provided a picture (seen below). The Calgary store in Market Mall is going to move from its present location to another spot in the same facility, near the south entrance. The move should allow the store's size to expand by about one-third to 7,287 square feet, reports ifoAppleStore.

An ABC affiliate station in Salt Lake uncovered a commitment from Apple to open a new store in the new City Creek Center mall, allegedly with a sweetheart deal of five years rent-free. The nearby Gateway Apple store could end up closing in favor of the new store, which would be substantially larger. Though Apple has been known to occasionally keep two stores that are near each other open, the Gateway and City Creek stores would be just 3,000 feet apart from one another. Apple does, however, have two stores in Glendale CA that are just 600 feet away from each other.

Expected later in the year is a new store in or near Bakersfield, California, possibly in the upscale Valley Plaza mall. Little is known about plans for this store, but it is expected to open by the end of the year.

Finally, The Plymouth Herald is reporting that the Zara fashion store at the Drake Circus shopping center in Plymouth along with another clothing store next door will be abruptly closed at the end of the month to make room for a future Apple store. The closures will result in the loss of around 36 jobs but the incoming Apple store hires will more than replace that number. There's no set timeline for the store's opening but given the swiftness of the deal to bring Apple to the center, it's likely the store will be open before year's end.

Report: FaceTime may be coming to 3G networks

20160(0)1updated 11:28 pm EDT, Fri May 18, 2012 iOS warning messages hint at service

Apple may be preparing to enable its FaceTime video-chat service to be used over 3G networks. The company has yet to confirm such plans, however Romanian Apple website iDevice has reportedly observed new warnings in iOS 5.1.1 that appear to be geared for FaceTime calls placed over 3G networks rather than Wi-Fi.As noted by Gizmodo and confirmed by AppleInsider, users running iOS 5.1.1 on an iPhone will be notified that "Disabling 3G may end FaceTime" if they attempt to disable 3G connectivity while participating in a FaceTime call over a Wi-Fi connection.

iPhones are said to maintain FaceTime calls even if the 3G connection is enabled or disabled, fueling speculation that the warnings may be an inadvertent confirmation that Apple finally may be willing to lift existing restrictions that prevent users from placing video calls over 3G cellular networks.

Even if Apple is willing to provide additional flexibility, it remains unclear if carriers will embrace the capabilities. FaceTime essentially works in the same manner as VoIP services such as Skype, bypassing voice-minute caps by transferring the communication onto a data plan.

Apple files to block Galaxy Tab 10.1 sales in US

0160(2)5updated 05:30 pm EDT, Sat May 19, 2012 Apple may help achieve hat-trick of import bans

On the heels of an appeals court win that suggested that Samsung should have been barred from selling its copycat Galaxy Tab 10.1 from the get-go, Apple has now filed a motion for a new injunction against the tablet asking it to be pulled from US shelves. The two companies are scheduled to begin high-level settlement talks on Monday, but should they fail the new injunction request could be ruled on as early as June 7.Apple won a similar ban in Germany on the original Galaxy Tab 10.1, forcing Samsung to make design changes that were judged sufficiently different to be able to avoid the injunction. That resulting product, the Galaxy Tab 10.1N, is not sold in the US and most other countries. There are already ITC US import bans in place against two of HTC's phones and some of Motorola's Android devices.

Apple won the reversal on Tuesday, which vacated Judge Lucy Koh's original ruling that there was no merit to Apple's copyright complaint regarding the iPad (the ruling on the iPhone portion of the case was left intact). Indeed, one of the three judges in the appeal, Circuit Judge Kathleen O'Malley, went so far as to issue a dissenting opinion from the other judges, saying that Apple should be granted an immediate injunction, and that Apple has been harmed by Samsung being allowed to sell the Galaxy Tab 10.1, according to patent court observer Florian Mueller.

The other two judges said simply that the matter should go back to the original court for review, since Judge Koh had never ruled on the iPad design patent (since it had previously been deemed invalid). Judge Koh is currently overseeing the settlement talks between Apple and Samsung, and will not take action on the matter until those talks are completed. Should those talks fail to produce a settlement, Samsung has until May 25th to produce a response to the injunction request, and Judge Koh may schedule it for June 7, the same date a separate injunction request against the Galaxy Nexus is scheduled to be heard.

The rulings are not expected to have much impact on either Apple's or Samsung's overall sales, but do clarify Apple's design rights -- and so far, the iPad maker has been largely successful in putting pressure on Android firms to redesign their products to be distinct from Apple's. Regardless of how the rest of the case goes, a redesign of the Galaxy Tab 10.1 to avoid Apple patents is likely.

Hands on: Fling Joystick for iPad and other tablets

2(2)2updated 04:30 am EDT, Sun May 20, 2012 MacNN goes hands-on with the Fling Joystick for iPad

The Fling Joystick for iPad is one of the more interesting accessories available for the iPad and other tablets. With the graphics capabilities of tablets approaching console quality, the biggest hurdle facing in-depth gaming on capacitive touchscreen devices is the lack of physical controls. Similar comments were of course leveled at the iPhone when it first launched back in 2007 without a physical keyboard, but those concerns soon evaporated. However, the volume selling games on both iPhone and iPad tend to be the casual games that rely on simple touch gestures. Yet, there are a number of first person shooters that use virtual single dual stick controls that look appealing, but aren't quite as popular.Unfortunately, most of the FPS titles are not often sighted in the top ten or top 20 games on the iTunes App Store in the longer term, despite the often jaw-dropping visuals on offer. Infinity Blade II, Shadowgun, Dead Space, Nova III and others are among the first games users who want to show off their iPad will show to their friends. Despite this, and the relative gaming depth that they offer the more hardcore gamers out there, this type of gaming seems to have been held back by the lack of physical controllers. In our experience, playing FPS and RPG games on the iPad can just be awkward and a bit off-putting.

Being fans of the Sony PS Vita, with its dual analog controls and quad-core graphics power, we have been keen to give the Fling Joystick for iPad a go. How does it compare to a real analog joystick seen on portable gaming consoles? Does it work as advertised? Does it offer the type of gaming experience that many of us crave on tablets? Is it worth the $20 asking price for one joystick, or is there any point shelling out for a $30 twin pack?

The Fling Joystick comes nicely presented with some quick-start instructions and a nice soft bag to stow the joystick when not in use when on the road. It attaches to a tablet using two suction cups, while its 'flexible engineering resin' spirals and capacitive touch point stretch out across the touchscreen. Some touch screen games allow the player to control where the virtual joystick appears on the screen, so for these games, it doesn

Flashback-K malware breaks down; no payment for creators

1120(1)0updated 04:42 pm EDT, Sun May 20, 2012 From 600,000 infections to 10,000; ad vendor won't pay

After possibly infecting up to 1.8 percent of the Macintosh population with a click-fraud macro through a Java vulnerability, the Flashback creators won't get paid despite their efforts, reports Computerworld. Following a coordinated security effort between antivirus vendors and security experts, remote malicious orders were blocked or prevented from effecting an estimated peak 600,000 infected computers. Apple joined the fray late, but provided patches and a removal tool for the malware. "Lots of security companies sinkholed Flashback's domains, and this caused

Apple to start enforcing sandboxing on Mac apps June 1

22120(3)2updated 05:34 pm EDT, Sun May 20, 2012 Apple sends sandboxing reminder to Mac devs

Apple sent an email reminder to developers working on apps for the Mac App Store letting them know that new programs will have to be compatible with the platform's forthcoming "sandboxing" constraints in order to be offered in the Mac App Store. Developers are expected to implement sandboxing within their apps by June 1, though existing programs can be updated after that date. Apple has previously extended the deadline for app sandboxing, first November 2011 to March 2012, and later to June 2012.The sandboxing effort is intended to increase security in OS X by limiting the operations a program can execute to program-essential functions, thus hindering malware. Currently, only new Mac App Store applications are required to be sandboxed, but Apple will be bringing a more extensive system-wide security feature, called Gatekeeper, in the forthcoming OS X Mountain Lion.

Apple is encouraging all developers to implement sandboxing on existing programs through updated versions as quickly as possible. Gatekeeper will introduce the option of preventing installs from any programs not "digitally signed" or from developers who are not registered with Apple (all legitimate Mac developers are already registered with the company).

Apple has been pushing the Mac App Store as a preferred method for software distribution since its introduction. The company shut down its Downloads page for Mac OS X, touting instead the ease of downloading apps through the App Store. The store saw success upon its release, with one million downloads in its first day of operation. Apple claims that the Mac App Store is now the primary software buying channel for OS X, surpassing Best Buy, Walmart, and Office Depot, and even spawning imitators from competitors such as Microsoft.

Foxconn to spend $210M on new Apple production line

an plant to host 35,800 workers

Asian manufacturer Foxconn is preparing to spend $210 million on a new Huai'an production line for Apple, according to China Daily. The plant has been announced by local officials, and is expected to consume 40,000 square meters (over 430,556 square feet), and employ 35,800 people. Predicted output is valued at 6 to 7 billion yuan, or somewhere between $949 million and $1.1 billion, with an import/export value of $55.8 million.Construction should take place in October. What Apple products might be built at the plant are unknown; the company could use it to supplement current iPhone and/or iPad production, or it could turn it towards a new product, such as Apple's rumored 7-inch iPad or even its upcomingTV set.

China Daily notes that Foxconn is planning to build another factor in Hainan province in early April. Foxconn's main campus is in the city of Shenzhen, where 200,000 or more people work on products for several major Western corporations including Apple.

Samsung exec hints cross-licensing as option in Apple suit

01602updated 11:21 am EDT, Mon May 21, 2012 Apple, Samsung CEOs to meet today in court-ordered talks

Samsung is still hoping to settle in its global legal disputes with Apple, Reuters reports. The head of the company's mobile division, J.K. Shin, spoke to journalists at a Seoul airport yesterday shortly before flying to the US. "There is still a big gap in the patent war with Apple but we still have several negotiation options including cross-licensing," he said. Shin is joining Samsung CEO Choi Gee-sung to meet Apple CEO Tim Cook today for court-ordered settlement talks.Until now, neither side has gone into specifics about settlement options. Cross-licensing would potentially allow both companies to continue making products without any design changes or paying extra royalties. With or without such a deal, both companies are likely to want to settle outside of court to avoid the time and expense of a trial, which could start July 30th if no agreement is reached.

OS X Mountain Lion to include automatic app downloads

11200updated 12:36 pm EDT, Mon May 21, 2012 This is a sponsored post

Automatic app downloads are being integrated into OS X Mountain Lion, checks show. The feature is present in the latest Developer Preview of the OS; under the new option, titles bought at the Mac App Store should, in theory, appear on any other Mac signed in with the same Apple ID. In practice though, the store is marking titles as "installed" on secondary Macs without actually copying any files. The function will likely be turned on in future Developer Previews, or at least the final version of Mountain Lion, due sometime this summer. It mirrors a similar option that has existed for iOS users since last year. Apple is increasingly trying to synthesize both operating systems; Mountain Lion, for instance, will soon get other iOS features like Reminders, Game Center, and the Notification Center. iOS has gradually become more complex, and can now operate without syncing to a Mac or Windows computer.

Apple's Tim Cook ranks as highest-paid CEO of 2011

11602updated 03:45 pm EDT, Mon May 21, 2012 This is a sponsored post

Apple CEO Tim Cook was the highest-paid CEO of 2011, according to a study released by the Hay Group and the Wall Street Journal. Cook's package for the year was valued at $378 million, although most of it is locked up in the form of stock grants issued after he took control from Steve Jobs in August. The first half of the shares will vest in 2016; the remainder will follow in 2021, contingent on Cook staying with Apple.Second on the list was Oracle's Larry Ellison, who took home $76 million, again mostly in the form of stocks. CBS' Leslie Moonves took in $69.3 million, of which $30 million was actually part of a bonus. JC Penney CEO Ron Johnson -- formerly Apple's head of retail -- brought in $53.3 million in restricted stock, while Motorola Mobility CEO Sanjay Jha grabbed $46.6 million, mostly in terms of stock options.

Corporations regularly use stocks as a way of ensuring the loyalty and performance of their executives. While a number of executives have left Apple since Cook assumed power, Cook himself has been with the company in different jobs for many years, and is now effectively the public face of the business.

ITC rules Kodak patent invalid in suit with RIM, Apple

01600updated 06:12 pm EDT, Mon May 21, 2012 Judgment undermines worth of Kodak patent portfolio

The US International Trade Commission has ruled that a patent involved in Kodak's lawsuit against Apple and Research in Motion is invalid, according to AppleInsider. In particular an administrative law judge has quashed the 6,292,218 patent, Method for Live View Display and Digital Camera Using Same, on the basis of claim 15 in the document. Kodak will reportedly appeal the decision to the full commission, a necessary step if it intends to continue suing Apple and RIM for infringing the patent. The decision could have potentially dire consequences for Kodak, which is already in the middle of Chapter 11 bankruptcy proceedings. The company must file an auction procedure by June 30th, but has been hoping to find a buyer for its 1,100 patents, which it has argued could be worth billions of dollars. The '218 patent is one of the more prominent ones in Kodak's arsenal.

In the ITC judge's preliminary ruling, claim 15 was rendered obsolete due to "obviousness." Had it held up, the judge notes that the iPhone 3G and several targeted BlackBerry phones would have violated it. The iPhone 3GS and iPhone 4 did pass scrutiny, however.

Kodak argues that the ruling was a "preliminary step in a process," and that proceedings will ultimately turn out in its favor. As evidence the company points to a separate decision, in which another judge found '218 valid and violated by Samsung.

Briefly: Voyager, Google-Motorola deal, Powerline networking

01600updated 07:01 pm EDT, Mon May 21, 2012 Voyager Mobile launches after 'malicious attack'

Following a delay of nearly a week after repeated denial of service attacks, low-cost Sprint reseller Voyager Mobile has launched in 22 states. Voyager provides Sprint's 3G and WiMAX network for $39 a month, contract free. Alternatively, a $19/month unlimited-talk plan is available. Chinese regulatory approval given for Google's Motorola purchase

China's Ministry of Commerce has approved Google's acquisition of Motorola. The European Commission and the US Department of Justice approved the merger in February, so few hurdles remain for the deal. China has ordered Google to keep its Android operating system free for five years as a condition of the approval. As part of the $12.5 billion deal, Google will own Motorola's 17,000 patents as well as acquiring Motorola's ongoing multinational legal disputes with Apple and other companies.

TP-Link adds AV500 model to powerline networking products

Similar to the AV200 line released earlier this month, TP-Link will be shipping the AV500 line by the end of the month. Now capable of 500Mbps over 300 feet, the new AV500 adapter kit is HomePlug AV standard-compliant, features a new ultra-compact design, plug-and-play with existing Ethernet network topography, supports IGMP managed IP transmission optimizing IPTV streaming, and has a power-saving mode that automatically reduces power consumption by up to 35 percent.

Panic unveils Coda 2, Diet Coda companion app for iPad

31200updated 07:14 pm EDT, Mon May 21, 2012 Both will be half-off regular price on debut day

Long-time Mac software developer Panic will be launching a major new version of its web-coding tool, now called Coda 2, along with an iPad companion app called Diet Coda on Thursday. The company describes Coda 2 as an "overhaul of every facet" of the editor, while Diet Coda is seen as a portable tool for making quick fixes to code when a developer is on-the-go. Both programs will be sold at half-price on Thursday, May 24 only.Coda 2 brings many changes both in the UI as well as in the coding itself, for example now offering code folding, a much-requested feature. Custom variables and functions can now be auto-completed, the program is now smarter about closing tags and uses better color-coding, and users can find and replace "placeholder" tokens to quickly tab to sections of code that need work.

The new version of Coda will automatically include full support for Git as well as SVN, and all the functionality of Panic's popular FTP tool Transmit. There is now a full MySQL editor included in the program, CSS gradients can be done visually right in place with the help of GUI pop-outs, and the Mac App Store version of Coda 2 will feature iCloud sync for sites and clips.

The interface has been redesigned with more tabs, plus-button functionality, an all-new sidebar and the ability to go full-screen in order to focus on code. Site management has also been improved with the introduction of a list view and automatic grouping of sites by dragging one onto another. The program now offers live code hints and better previews and validation.

Users who also spring for the Diet Coda program can also use the iPad as a wireless live preview of the site a user is working on, an ideal use for the iPad while coding. In addition to acting as a preview for Coda 2, Diet Coda can handle fast syntax highlighting and remote-only editing, and includes both the functionality of Transmit for FTP duties as well as the SSH terminal features of Panic's Prompt product.

Diet Coda also features a document shelf, clips library, find-and-replace, a contextual keyboard and a "Super Loupe" magnifier that goes beyond the loupe highlighting built into iOS for a more coding-specific magnification. The program is also Retina Display-ready for the new iPad.

Pricing on the new Coda 2 is a bit complicated -- the program will be priced at $50 (half off its usual retail) on its debut this Thursday, May 24. After that it will rise to $75, which the company calls "upgrade pricing for everyone" for a limited time, and then will eventually return to its $100 normal pricing. Buyers who purchased Coda on or after April 10th directly from Panic will receive a free upgrade, but Mac App Store buyers have no mechanism for this and thus will have to pay the upgrade pricing during the limited promotion.

Diet Coda will debut for $10 on the iOS App Store for a limited time, then go up to $20 normal pricing.

Apple reveals details of NC data center energy plan

11203updated 10:03 pm EDT, Mon May 21, 2012 Applying knowledge of cooling to buildings

Some details revealed about how Apple intends to make its Maiden, North Carolina data center almost entirely powered from renewable-energy sources have come to light, showing a combination of solar and fuel-cell technology and practical energy-saving policies. The plans show that the company behind the iMac are also applying some cooling lessons learned from computers to the buildings, such as variable-speed fans.Apple plans to implement two solar farms of approximately 100 acres each, along with a biogas-based fuel cell installation that will go online later in the year. Between the two, the company will already be generating roughly 60 percent of the data center's energy needs (about 45 megawatts) by the end of 2012, but Apple says it will make the remainder renewable "through sourcing arrangements with local and regional clean-energy sources," according to its environmental website.

These plans, reports ZDNet, have been in the works for years and are not a reaction to Greenpeace's recent pressure campaign against Apple, which is really targeting the company's use of mostly coal-based Duke Energy, which provides electricity using coal, oil and nuclear power to a sizeable portion of the US southeast. The company also operates some hydroelectric power plants in Brazil.

Apple is currently one of Duke Energy's biggest single customers, but a shift by Apple to demanding renewable sources for its data center's power could pressure the company to compete more aggressively with renewable-energy investments, such as solar or wind power. Apple plans to register the renewable energy generated by its own solar and fuel-cell installations with the North Carolina Renewable Energy Tracking System (NC-RETS) in order to address complaints about transparency on its energy use.

Apple's data centers already engage in conservation measures typically employed in data centers around the world, such as using motion sensors so that unused parts of the building are kept dark, power-distribution systems that spread electricity around at higher voltages, LED lighting and a white "cool-roof" design. In addition, the Maiden facility will employ a chilled-water storage system to improve AC chiller efficiency, which helps shift consumption of air-conditioning power to off-peak hours.

Also incorporated into the design of the facility is "free-air cooling," which allows cool air outside the buildings to be drawn in and used to remove generated heat, an idea also employed in some of Apple's computers such as the iMac, which uses convection cooling to minimize the use of fans. Likewise, the Maiden facility employs variable-speed fans with sensors to help them automatically handle demand for cooling. These measure are estimated to handle the data center's cooling needs for up to 75 percent of a typical day, particularly during the cooler parts of the year.

Apple has said publicly that it plans for its Newark, California and forthcoming Prineville, Oregon data centers to also shift to more clean power through sourcing relationships and other measures. The new center in Prineville is planned to be as energy-independent and use renewable resources on the same scale as the Maiden facility.

Public figures pay tribute to Jobs at Webby Awards

10updated 12:50 am EDT, Tue May 22, 2012 Dreyfuss, Obama, Clinton, children, others

A group of notable public figures, including two US presidents and a class of schoolkids -- along with the reunited "Mac and PC" team of Justin Long and John Hodgman -- paid tribute to Apple co-founder and former CEO Steve Jobs at the Webby Awards held yesterday in New York City. As part of the ceremony, a video tribute was run featuring "five words" (and sometimes more) from various celebrities and politicians who in turn paid tribute to Jobs, who died in October.Among those in the video were Web pioneer Vint Cerf, Apple board member Al Gore, astronaut Buzz Aldrin, Star Wars creator George Lucas, comedic journalists Jon Stewart and Stephen Colbert, talk-show host Jimmy Fallon, comic Sarah Silverman, publisher Arianna Huffington and a class of unidentified schoolchildren. The video also featured appearances by former US President Bill Clinton as well as current President Barack Obama.

The video was preceded by a longer introduction by actor (and the voice of the TV version of Apple's famous "Here's to the Crazy Ones" ad) Richard Dreyfuss, who recalled some of the background behind the ad, calling it a response to a world filling up with mediocrity. He ended his speech by reverting to the preferred five-word "thank you" speeches popular at the Webbys, saying Jobs was the "exception that proves the rule."

In the video tribute, Lucas thanks Jobs "for making technology into art" while Seth Meyers of SNL appreciates the invention of "a handheld Internet" and the schoolkids said he was responsible for "making the classroom fun." Many of the tributes in the video were clearly shot on an iPhone or iPod Touch camera.

Jimmy Fallon added that Jobs "made turtlenecks sexy again," while Colbert noted Jobs' "meticulous attention to detail." Jon Stewart used his five words to say "43 patented inventions. Check Wikipedia!"

Al Gore said "Steve Jobs was insanely great" while Clinton thanked Jobs "for spreading American ingenuity worldwide." Obama, who along with Clinton got to speak twice in the video, said "thank you for thinking different," and later said that "when it comes to Steve Jobs, we only need one word: amazing" to end the video.

Jobs was posthumously awarded a Grammy in February for his meritorious contributions to the music industry, and he was also honored during the "In Memoriam" montage at the Academy Awards. Apple itself has won Webby awards, including two in 2004 for iTunes. The video from yesterday's Webby Awards is below.

Briefly: Sony tablet at Billboard Awards, Lorex baby monitor

01600updated 02:18 am EDT, Tue May 22, 2012 Tablet P replaces 'the envelope please' at awards

Yesterday's 2012 Billboard Music Awards in Las Vegas replaced the traditional "red envelope," instead using a Sony Tablet P model to read the names of winners. Because the tablet uses a folding design, it was ideal to recreate the "reveal" moment while giving it a digital update. The awards were hosted by Modern Family's Julie Bowen and Ty Burrell, and featured noteworthy tributes to Whitney Houston and Donna Summer, the latter of whom died unexpectedly just last week. UK pop star Adele was the biggest winner, collecting 12 of the 46 awards given out. The Sony Tablet P sells for $399 with a two-year AT&T contract.
Lorex Live View baby monitor reviewed

Infant and toddler review site BabyRecs has reviewed the Lorex Live View Video Baby Monitor, a camera and wireless video monitor that allows children to be viewed in their room with color day vision and black-and-white night vision at night. Hands on: TouchType case for iPad, bluetooth keyboard

20updated 03:45 am EDT, Tue May 22, 2012 Kickstarter runs through June 7

High-quality covers for the iPad are a prevalent accessory. Once relegated to boutique status, they can now be had for a variety of prices ranging from $40 to over $100. The official Apple case for the iPad 2 and current-generation iPad sits at the low end of the range financially. When a new product shows up that's competitively priced with Apple's offering, it's worth a look. An already fully-funded Kickstarter project by Washington DC metro-area Salman Sajid is still underway, and MacNN got an early look at the product that carries both any generation of iPad as well as an Apple Bluetooth keyboard.
Shortly after the Kickstarter project met its original goal, Sajid went ahead and paid for an initial production run out of his own pocket in order to be sure it met expectations. The box is simple, backed in brown with just the logo of the product on the front case, understated and clean.

Opening the box, the actual case that emerged was what he called the espresso leather -- a fortuitous accident, as it turns out. When he was dealing with the manufacturers of the case, Sajid hadn't asked for this particular leather to be supplied. It was, and as it turned out, it was the most popular version on his the ongoing fundraiser for a time.

Evizone delivers a unique take on business comms security

01600updated 05:53 am EDT, Tue May 22, 2012 Evizone keeps confidential correspondence confidential

At a time when businesses are exchanging more and more information online, with a corresponding risk of data theft from cyber hackers, Internet security is more critical than it has ever been. Evizone has developed a unique approach enabling the secure exchange of files, view-only copy protected messages and documents so that businesses can be confident that their vital corporate information remains only in the hands of its intended audience. MacNN recently had the opportunity to put some questions to Evizone CEO Andrew Coutts about what sets Evizone apart from the crowd and why businesses that value corporate security should consider it instead of email and other file sharing services.Coutts is one of four industry veterans at Evizone, who have a combined total of 75 years experience in the software and IT industry in a company with 24 staff. At the heart of its service is some key patent-pending technologies including an anti-screen capture technology that goes well beyond simple disable print functions. Users at both ends of the system require its Software as a Service to be installed on either their Mac or PC with Evizone

Next iPhone may have 3.95-inch display with 1136x640 pixels

61608updated 08:39 am EDT, Tue May 22, 2012 Sixth-gen iPhone prototypes testing 3.95-inch display

More details have emerged about the new 4-inch display that Apple is rumored to be testing for the next iPhone with 9to5 Mac claiming its sources have confirmed that Apple is currently testing an iPhone with a 3.95-inch display. The new display is also expected to retain a Retina Display level of pixel density, maintain the same width as the current display (1.94-inches), but be stretched to 16:9 ratio at 3.45-inches tall. If accurate, this would permit a 16:9 movie to play in its native aspect ratio using the full display sans the black bars while even potentially retaining the same overall phone size.According to 9to5 Mac, prototype handsets with the larger display are floating around the Cupertino campus clad in shells to hide their revised design from all unauthorized on-lookers. The two main prototypes are said to be in the PreEVT stage of development and carry the codenames N41AP (5,1) and N41AP (5,2). However, 9to5 Mac is unsure which of the two prototype handsets is expected to make its way to production.

Further, the additional display real-estate is expected to be fully utilized by a version of iOS 6 that will be specially tailored for the new display resolution. Apple is said to be experimenting by adding an additional row of icons to the home screen, bringing the total number of rows to five, plus the docked icons. Extended views of other iOS functions are also being accommodated. For example, while double-clicking on the home button reveals a single row of apps in the app tray, this could be doubled to show twice as many at any one time.

The new iPhone prototypes are also said to be carrying Apple

With iPad included, Apple leads mobile PCs in Q1 2012

01600updated 10:34 am EDT, Tue May 22, 2012 HP leads in actual notebook share

Apple led the market in mobile PC shipments during the March quarter, at least when including the iPad, according to preliminary NPD data. The company shipped 17.2 million iPads and MacBooks, representing a 118 percent jump year-over-year, and 22.5 percent marketshare during Q1. About 80 percent of those units were iPads though, whereas the other top sellers succeeded on the basis of notebook shipments.HP came in second with a 11.6 percent share, or 8.9 million units. The company was followed by Acer with a 9 percent share -- 6.9 million units -- and Lenovo, which took home a 7.7 percent share through 5.9 million systems. Dell's fifth-place finish still gained it a 7.3 percent share and 5.6 million units.

NPD does note, though, that amongst notebook vendors, HP was one of the only companies to increase shipments year-over-year, gaining just under 700,000. It continued to beat Apple and other companies in that category with a 16.2 percent share, losing some of its advantage because EMEA (Europe, Middle East, Africa) numbers slipped 17 percent year-over-year. In order it was followed by Acer, Lenovo, Dell, and ASUS.

Apple seized a massive 62.8 percent of the tablet market with 13.6 million iPads. Samsung reclaimed second place, but with just 1.6 million units, or a 7.5 percent share. The company displaced Amazon, which fell to third with 900,000 tablets and a 4 percent share. RIM and ASUS tied each other, selling 500,000 apiece, achieving 2.3 percent of the market each. Barnes & Noble dropped out of the top five.

Global mobile PC shipments amounted to 76.2 million units, down 15 percent from Q4 2011, but up 30 percent year-over-year. Tablet sales shot up 124 percent versus 2011, whereas notebooks rose 12 percent. China is said to be increasingly important to the mobile PC industry. "The China region had sequential quarter shipment growth, achieving 13% for mobile PCs overall, 12% for notebook and mini-note PCs, and 16% for tablet PCs," writes senior NPD analyst Richard Shim. "This is noteworthy given the sequential declines in all other regions as well as the declines in other product categories including TVs and monitors."

TiVo Stream to push TV to iPhones, iPads

00updated 11:46 am EDT, Tue May 22, 2012 Promises interruption-free transfers

TiVo has announced early details of a new service, TiVo Stream. The platform will allow owners of Premiere or Premiere Q DVRs to access content on an iPhone or iPad. More importantly however, people will be able to stream or download shows to multiple devices simultaneously without interrupting playback on a TV. Users should in fact be able to "quickly transfer shows to their mobile device for viewing outside the home," though few other details have been made public. The company is promising to "release both products at retail and through select cable operators," but has not set any kind of launch window. More information is due to be released in the coming months.

Even less is known about a new "IP set-top box," announced simultaneously. That hardware should push content to secondary TVs, but lacks a name or any other information.

Hulu Plus updates with iPad Retina support, new interface

01updated 12:40 pm EDT, Tue May 22, 2012 Video player gets 're-engineered'

Video service Hulu has released a major update of Hulu Plus for iOS, v2.5. Most of the focus of the update is on iPad support, since it adds compatibility with the third-generation iPad's Retina display, and also enhances the native interface. Hulu has moreover improved AirPlay mirroring and HDMI output, which should also work when an iPad is in operating in split view mode. Users must have at least an iPad 2 or an iPhone 4S.The app in general now supports browsing shows by genre, and uses an overhauled video player with various optimizations. The app is a free download; the Hulu Plus service however costs $8 a month, and is needed for mobile support. This also provides access to complete current and back seasons of shows, where licenses allow; the free web-based Hulu only hosts recent episodes.

Leaked next-gen iPod touch part hints at taller display

02updated 01:48 pm EDT, Tue May 22, 2012 Claims may be difficult to mesh with rumored iPhone sizes

Images have leaked of what is allegedly a part for the next-generation iPod touch, according to a MacRumors source. In particular, the images show a front panel produced by an unidentified supplier. Noticeably it has room for a much larger display, which the supplier claims should measure 4.1 inches. If the part is authentic, the exact size of the display may still be questionable. Apple tends to keep screen sizes consistent between the Touch and the iPhone, and one recent report framed the next-generation iPhone at 3.95 inches, although other reports have said its screen will measure at least 4.

The supplier is in fact said to have listings for several next-gen iPhone parts, including a Home button flex cable, and front and rear cameras. The first two are described as showing differences between equivalent parts for the iPhone 4S. The rear camera part isn't paired with an LED flash, but that may simply be a separate component.

Parts leaks can indicate that a new Apple product is closer to production. The next-generation iPhone is believed to be some time away from shipping, however. Most reports have positioned a launch in the fall, possibly in October, the same month the iPhone 4S shipped.

pod2g Confirms Untethered Jailbreak Also Works on iOS 5.1.1

pod2g seems to be on a roll. He has just confirmed that his untethered jailbreak also works on iOS 5.1.1.

Few hours back, he had confirmed that his untethered iOS 5.1 jailbreak works on the new iPad and even posted a video of the untethered iPad 3 on iOS 5.1 on his blog.

He just tweeted:

OK, tested on an iPad 3,1 running 5.1.1. Jailbroken untethered. :-) No issue.

pod2g has clarified that since his untethered jailbreak works on iPhone 4 and iPad 3, it should work with other iOS 5.1 devices like iPhone 4S and iPad 2 as well. But it may not work with Apple TV 3. So the same should apply for iOS 5.1.1.

pod2g has said that it will still take him "some weeks" to release a user friendly tool for his untethered jailbreak for iOS 5.1. Until then, iPhone 4S and iPad 2 users can use the latest of Redsn0w to downgrade to iOS 5.0.1 and jailbreak their device using Absinthe jailbreak.
